Question:
Do I have to go to court for a workers’ compensation claim?
Answer:
Many of our clients experience fear and anxiety when they have to go to court. We are here to walk you through the process that is in place to benefit you. If we’re dealing with an insurance company that has decided not to pay a claim, or that they’re going to be unfair in some way, the court system is there to ensure that that doesn’t happen. Workers’ compensation cases are non-jury. There’s just one judge, who’s there to decide the issues that are disputed. Those judges tend to be sympathetic, and they tend to allow our clients to speak their truth and to explain exactly what happened and what they’re seeking from the court. We will make an effort to resolve a claim without getting into litigation or going to trial, if you so choose. At the end of the day, if there’s an offer that’s made to resolve a claim, it’s up to you whether you take that offer. We provide the best advice to help you decide whether to take an offer that’s made or take it all the way to trial.
