If I am permanently unable to return to work, am I entitled to disability retirement benefits through my place of employment?
Answer:
In Alabama, workers’ compensation benefits for total disability are paid through the end of your life. You can receive, essentially, permanent lost wage replacement benefits pursuant to the Workers’ Compensation Act. To be entitled to those benefits, you have to prove that you’re not able to do any work in the labor market that would be comparable with your vocation profile- your age, your education, your work experience, and then the injury that you’re dealing with. We have benefits that are paid until death. We also have death benefits that go to dependents if someone loses their life on the job. Those are paid for a maximum of 500 weeks.
