What do I need to know about settling a workers’ compensation case?
Answer:
Settlement of a workers’ compensation claim requires either court approval or approval through an ombudsman. An ombudsman is an employee of the Department of Labor who has the statutory authority to sign off on and approve a workers’ compensation settlement. A lot of claims in Alabama are resolved through that ombudsman program, and the injured worker does not have an attorney. An injured worker has been made an offer to settle their claim, they’ve been given some paperwork, and oftentimes, they sign off on those documents not fully understanding what they are doing, or the rights they are surrendering. Settlement is, in theory, court approved or ombudsman approved to try and protect the rights of the injured worker. You need an attorney to make sure you are being treated fairly.
